I know this user very well.And I do know where she got the picture. But she Has mentioned that Most of here work is just coloring pages. She doesn't know any better. She is very Nyeave and very kind. She try's her best and just want the world to think the best of her. I am assuming she is very young, if you have ever talked to her you'll see that she is very innocent. She was just using that picture and others for her stories. she ment no harm. |

"Coloring pages" created specifically to be used by other people aren't bad as tracing over screenshots, etc.

Not necessarily, Nine times out of ten the stipulations of use state that it is for private use only.
This means...that a individual may print and color the imagery but they arr not permitted to put the final peice on public display. This site is puplic display and thus in violation with such stipulations.

may i point out that nintendo has copyright over any pokemon related matter no matter who does it? in fact its like that with just about all images on here. any 1 gets vindictive and boom fac goes byebye. only way t stay on the white side of the legality thing is completly original art thought of by the user. otherwise its woking in the halflight of the law all the way to illegal. just pointing this out _________________ with this frame of mind you better pray i never get a point of view gun, too late i just did. just pray i dont aim at you then! |

You do not understand Copyright laws at all.
You could not be further off base, Nintendo does hold copyright over Pokemon, however this gives them no right whatsoever to an individuals original Derivitive work. Derivitive works are copyright to their respective creator, (IE the person who put it on to a fixed medium). Derivitive works include any and all imagery, literary works, musical works, including any accompanying words, and architectural works that are derived from an existing previously copyrighted design.
Now, no one can hold a copyright on an idea, so this means that just because someone is drawing Pokemon, the fact the ideaology of the charachters is not original does not in anyway negate the originality of the derivitive works image they created baised on Pokemon.
FAC will not go Byebye, the majority of works displayed on this site are derivitive works and are protected by copyright to the ones who created the individual images _________________ [b]RPG[/b]-[i]n[/i]. Strictly speaking, Nintendo's copyright over Pokemon applies only to the game's [b]source code and resource data[/b], e.g. event scripting, music tracks, background graphics, and character sprites (which is why you can't use official sprites for a submission).
