Well, I think the only reason that they have this rule to allow others to copy your exisitng work is becasue a lot of the 'original' works on these types of sites are with some sort of photo reference, either from a magazine, comic book etc. So to allow people to submit those pictures, it would hardly seem sensible to expect no one else to do the same with regards to what is already done. Case in point, I do a lot of portraits of celebrities, if I happened to pick a particular photo for reference and then posted my drawing, then technically no one else would be allowed to use that same photo for reference without this rule, which harldy seems fair. If it happens to be an original piece of art that you created and someone tried to copy, I would take it more of a compliment than anything else (plus, then you get a feel for what professional photograpghers or cartoon artists feel like when they see 'fanart') |

That's basically the same rules as we have on FAC regarding artwork based on other people's art or posters/photos/whatever.

Yeah, it surprised me when I first read that, too O_O!
Personally, I think if someone extensively uses any form of copyrighted reference (that's not copyright to them), they ought to at least give credit : /. Whether they're copying one of my arts or a background from a photo. But I guess a lot of other people don't feel the same way~. |

A lot of us at DA had a discussion about this. Fayore, just as Pen said, one should take it as a compliment to have someone make fanart of ur work.
Besides, everyone gets a feel of what it's like to have people make fanart of ur stuff without your permission. Besides, there is nothing that can be done by the site admins because of the community's size. Also, how many people have u seen give credit to the original creators. I'm not condoning their actions; i'm just saying that it's just too hard to track and deal with. Now, if they were claiming the original character/storyline creations and selling that work w/out permission from the original creator, then there would be a problem.
I should know, I have had a person make some fanart of my work. I didn't panic b/c I knew they were not making a profit off of my original creation and I could tell that it wasn't an exact copy of my own work.
So don't take offense to DA's rules. They are not very different from what rules everyone must follow on FAC and on other sites.

hmmm it is complicated. but i think its interesting...i tried joining...but they say there were "abusive users" who would not allow u to join or something. and ive tried joining a couple of times in the past...it still wont let me, for the same reason. -_________- |
