Someone tell me how this works.

Judge tells defendant, you're next court date is October 18th.
Defendant asks judge to be sure, October 18th?
Judge says yes, be here on October 18th at 9:00am

Defendant double checks with Lawyer, October 18th at 9 right?
Lawyer confirms it.

Later conversation with lawyer, to be sure, my court date is October 18th at 9 right?
Lawyer confirms it.

On September 9 Defendant gets a call because he missed the Septemeber 7th court date that no one knew about. Does the lady at the desk beside the judge not listen to him?

wow thats crazy, sad part it i know a few people that something similar like that happened two.

new information. Bail has been revoked for said defendant and warrant has been issued for said defendants arrest.

although, the defendants lawyer said that she also knew that it was announced in court that the next hearing was in october so she has filed a motion to have the warrant withdrawn and the bail reinstated since she believes that it is the judges office who has made the mistake.

Warrant is withdrawn, Defendant is safe until October 18th... thank god.

It happens. Happened to my mother several times (although in her case, she wasn't the one on trial).

That's why you should talk to the court clerk instead when it comes to schedules. While the judge may decide when the hearing should be, its the clerk that actually goes and schedules things. It is quite likely that the judge won't even remember all the things he schedules, or belatedly something happens that the day he announced suddenly becomes unavailable, so even if he said Oct 18, if the clerk schedules it for Oct 9, the hearing/trial will likely be held on Oct 9.

You can, of course, contest it, but for the sake of avoiding future problems, when it comes to schedules, talk to the guy/lady that actually puts the schedules on record.
